Please read these Terms of Service ("Terms") carefully before using the WorkBrain OFF mobile application ("App") operated by WorkBrain OFF ("we", "our", "us"). Please also review our Privacy Policy.
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
2. Description of Service
WorkBrain OFF is a wellness application designed to help users transition from work mode to sleep mode through guided stretching exercises ("Body Reset") and breathing/audio sessions ("Mind OFF"). The App also provides morning check-in functionality and progress tracking features.
3. Subscriptions
- Free Trial: We may offer a 7-day free trial for new subscribers. If you do not cancel before the trial ends, you will be automatically charged the subscription fee.
- Billing: Subscriptions are billed on a monthly or annual basis through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Cancellation: You can manage and cancel your subscription through your App Store account settings. Cancellation takes effect at the end of the current billing period.
- Refunds: Refunds are handled by Apple in accordance with their refund policy. We cannot process refunds directly.
4. User Accounts
The App uses anonymous authentication. No personal information such as name or email is required to use the App. Your anonymous account is tied to your device. If you uninstall the App, your account data may not be recoverable.
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers or networks
- Copy, distribute, or share the App's content (including audio, exercises, and animations) without our written consent
- Use automated systems to access the App
6. Intellectual Property
All content in the App, including but not limited to text, graphics, audio, animations, and software, is the property of WorkBrain OFF and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. Health Disclaimer
The App is designed for general wellness purposes only. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition or disease. The stretching exercises and breathing techniques provided are general in nature. If you have any health concerns, please consult a qualified healthcare professional before using the App.
8. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee that the App will be uninterrupted, error-free, or secure.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
- Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
9. Modifications
We reserve the right to modify or discontinue the App, or any part thereof, at any time without prior notice. We may also modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.
10. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tokyo, Japan.
